David Florida Laboratories (“DFL”) Fair Access Policy
1. PURPOSE AND SCOPE
The purpose of this fair access policy (the “Policy”) is to establish guidelines for the equitable, fair and non-discriminatory provision of testing services at DFL, a facility owned by the Canadian Space Agency (“CSA”) and operated by MacDonald, Dettwiler and Associates Corporation (“MDA Space”). This Policy applies to all testing services offered by DFL to third-party companies and organizations including MDA Space (collectively, the “Users”).
2. COMMITMENT TO FAIR ACCESS
DFL, CSA and MDA Space are committed to providing open and equitable access to testing services on a non-discriminatory basis, without favoring or disadvantaging any User including MDA Space. MDA Space fully supports DFL's prime mandate to support space-based testing in Canada. Access to testing services will be provided in accordance with this Policy and the applicable MDA Space’s terms and conditions of DFL (the “Terms and Conditions”).
3. ACCESS CRITERIA AND PROCEDURES
Users seeking testing services must submit a completed request for testing activities and related services form (the “Request for Test Form”) to the designated MDA Space contact at DFL (the “MDA Space Contact”). Requests will be evaluated based on technical feasibility, resource availability, and compliance with safety and regulatory standards. Upon receipt and acceptance by MDA Space of the Request for Test Form, the User’s purchase order and deposit, testing services will be allocated on a first-come, first-served basis, subject to scheduling and resource availability. Where conflicting requests arise, priority may be determined based on the order of request submission and the technical requirements of the proposed testing. All Users shall be charged in accordance with the fee schedule, applicable to all Users without exception.
4. CONFLICT OF INTEREST AND IMPARTIALITY
MDA Space shall not give preferential treatment to any User based on the nature of the User’s business, prior dealings, or affiliation with MDA Space. Employees of MDA Space shall maintain impartiality in the allocation of testing resources and shall disclose any potential conflicts of interest that may affect the fair allocation of resources. Any User who believes they have been subject to unfair treatment or discrimination in accessing testing services may submit a complaint to the MDA Space Contact for review.
5. REVIEW AND UPDATES
This Policy shall be reviewed periodically and updated as necessary to reflect changes in operational capacity, regulatory requirements, or corporate policy.
6. INCORPORATION INTO TERMS AND CONDITIONS
This Policy shall be deemed incorporated by reference into the Terms and Conditions. By submitting a Request for Test Form or accessing testing services, Users agree to comply with this Policy and the Terms and Conditions.
